This Privacy Policy explains how Yavio GmbH ("we", "us", "our") handles information in connection with the Preisvergleich comparison app ("the App"). The App is accessible through ChatGPT and, where available, other agentic clients via the Model Context Protocol (MCP).

2. What We Do

Preisvergleich helps users in Germany compare live offers for electricity tariffs, natural-gas tariffs, instant-access savings accounts (Tagesgeld), fixed-term deposits (Festgeld), and private current accounts (Girokonto). To produce a comparison, the App forwards the inputs you provide in real time to our third-party data provider procheck24 GmbH (https://www.procheck24.de/) and related CHECK24/procheck24 services, which return ranked offers and external links.

3. Information We Process

The App processes the following categories of information:

Comparison inputs. Depending on the comparison, this may include a German postal code (PLZ), annual electricity or gas consumption in kWh, investment amount, preferred fixed-deposit term, expected monthly income, and filter settings such as eco-energy preference, contract duration, price guarantee, or bonus preferences. These inputs are transmitted to procheck24/CHECK24 services in real time to retrieve offers and are not persistently stored by us after the response is delivered.

External contract or account-opening data. If you click an external link from the App, you leave ChatGPT and continue on a third-party website such as procheck24, CHECK24, an energy provider, or a bank. Any additional information you enter there, such as name, address, contact details, bank details, meter information, previous supplier details, identity or account-opening information, is processed by that third party according to its own privacy policy. Yavio GmbH does not receive or store the data you enter in those external flows, other than non-identifying referral, commission, or statistics information where applicable.

Usage and analytics data. To improve the App and understand how it is used, we collect anonymized usage data through our own analytics system (Yavio SDK). This may include interaction events, session information, and, where applicable, pseudonymous user identifiers. Analytics data is processed and stored on our Google Cloud infrastructure within the European Economic Area (EEA); see Section 5 for hosting details. We do not use third-party advertising trackers for this purpose.

4. Legal Basis for Processing (GDPR)

We rely on the following legal bases for processing:

Comparison service (Art. 6(1)(b) GDPR). Processing the inputs you provide and forwarding them to procheck24/CHECK24 services is necessary to provide the comparison you requested.

External contract or account-opening flows (Art. 6(1)(b) GDPR). Where you choose to continue through an external link, the processing of information you enter on the external website is handled by the respective provider, bank, procheck24, or CHECK24 entity. They act as separate controllers for those flows, not Yavio GmbH.

Analytics (Art. 6(1)(f) GDPR). The collection of usage and analytics data is based on our legitimate interest in improving the App and understanding how it is used. You may object to this processing at any time by contacting us (see Section 12).

Where comparison inputs or analytics data do not constitute personal data, for example fully anonymized data, GDPR does not apply to that processing.

5. Third-Party Services

procheck24 GmbH and CHECK24 services. To provide comparisons and external continuation links, the App sends your comparison inputs to procheck24/CHECK24 services. These services operate with their own data processing practices and may act as separate controllers for external contract or account-opening flows. Host platforms. The App operates through ChatGPT (OpenAI) and other clients that connect to the App via MCP. Conversations within these clients may be processed by the respective platform operator in accordance with its privacy policy and terms of use. This processing is outside of Yavio GmbH's control.

Hosting infrastructure (Google Cloud). The Yavio platform, including the analytics system described in Section 3, runs on infrastructure provided by Google Cloud, operated by Google Cloud EMEA Limited (Ireland), which acts as a processor for Yavio GmbH under Art. 28 GDPR. Data is hosted in Google Cloud regions located within the European Economic Area (EEA). To the extent Google's U.S. parent company may have potential access to data, we rely on the EU Standard Contractual Clauses and the EU-US Data Privacy Framework as transfer safeguards. 6. International Data Transfers

procheck24 is based in Germany and typically processes data within the European Economic Area (EEA). Host platforms such as OpenAI may process data on servers located outside the EEA. By using the App through such a platform, you acknowledge that the inputs you provide may be transmitted to servers in countries that may not provide the same level of data protection as the EEA. Where applicable, we rely on the safeguards provided under Art. 49(1)(b) GDPR, transfer necessary for the performance of the service you requested, or on the safeguards put in place by the respective platform operator.

7. Data Storage and Retention

Comparison inputs are not persistently stored by Yavio GmbH. Queries are processed in real time and are not retained by us after a response is delivered.

External contract or account-opening data is processed and stored by the respective third-party provider according to its own retention policies.

Analytics data is stored on our Google Cloud infrastructure within the EEA and retained only for as long as necessary to fulfill the purposes described in this Privacy Policy. We regularly review and delete analytics data that is no longer needed.

8. Cookies and Tracking Technologies

The App does not use cookies or third-party advertising tracking technologies. We use our own analytics system (Yavio SDK) to collect anonymized usage data as described in Section 3. No data is shared with third-party advertising providers.

9. Children's Privacy

The App is not directed at children under the age of 13. We do not knowingly collect any data from children.

10. Your Rights

If you believe we hold any information related to you, please contact us and we will address your request promptly.

Under the GDPR, you generally have the right to access, rectification, erasure, restriction of processing, data portability, and objection. You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU Member State of your habitual residence, place of work, or place of the alleged infringement. For requests concerning data processed in external contract or account-opening flows, please contact the respective third-party provider directly, as they act as separate controllers for that processing.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted at this URL with a revised effective date.
