Shipal — Package Tracking App

These Terms of Service ("Terms") govern your use of Shipal ("the App"), a package tracking application operated by Yavio GmbH ("we", "us", "our"), accessible via the ChatGPT platform.
By using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.
1. Description of the Service
Shipal is a package tracking tool that allows you to track shipments from carriers worldwide by entering a tracking number. The App retrieves tracking information through third-party services, including 17track (https://www.17track.net). We collect anonymized usage data to improve the App, as described in our Privacy Policy.
2. Use of the App
You may use the App for lawful purposes only. You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Attempt to interfere with or disrupt the App's functionality.
- Use automated means to access the App beyond its intended use.
- Track shipments that you are not authorized to track.
3. ChatGPT Platform
The App operates within the ChatGPT platform provided by OpenAI. Your use of the App is also subject to OpenAI's Terms of Use and Usage Policies. In the event of a conflict between these Terms and OpenAI's terms, OpenAI's terms shall prevail with respect to your use of the ChatGPT platform.
4. Third-Party Services
The App relies on third-party tracking services (including 17track) to provide shipment data. We do not control these services and are not responsible for the accuracy, completeness, or availability of the tracking information they provide.
Your use of tracking data is also subject to the terms and policies of the respective third-party providers.
5. Availability and Accuracy
We strive to keep the App available and functional but make no guarantees regarding uptime or uninterrupted access. Tracking results depend on data provided by carriers and third-party services, and we cannot guarantee their accuracy or timeliness.
6. Intellectual Property
All rights in the App's name, branding, and original content remain with Yavio GmbH. You may not copy, modify, or distribute any part of the App without our prior written consent.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Yavio GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.
Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law, including mandatory provisions of German law.
9. Suspension and Termination
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. Upon termination, your right to use the App ceases immediately.
10. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted at this URL with a revised effective date. If you do not agree with the updated Terms, you should discontinue use of the App. Continued use of the App after 30 days following the posting of changes constitutes acceptance of the new Terms.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the jurisdiction of the competent courts in Germany.
