These Terms of Service ("Terms") govern your use of Preisvergleich ("the App"), a comparison application operated by Yavio GmbH ("we", "us", "our"). The App is accessible through ChatGPT and, where available, other agentic clients via the Model Context Protocol (MCP).

By using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. Description of the Service

Preisvergleich helps users in Germany compare live offers for electricity tariffs, natural-gas tariffs, instant-access savings accounts (Tagesgeld), fixed-term deposits (Festgeld), and private current accounts (Girokonto). Based on inputs you provide, the App returns ranked cards with prices, rates, fees, contract details, filters, and external links. Offer data and the underlying comparison logic are supplied by our third-party data provider procheck24 GmbH (https://www.procheck24.de/) and related CHECK24/procheck24 services. We collect anonymized usage data to improve the App, as described in our Privacy Policy.

2. No Energy, Legal, Tax, or Financial Advice

The App provides general comparison information. It does not constitute energy, legal, tax, investment, banking, or financial advice. The ranking and presentation of offers depend on the data we receive from procheck24/CHECK24 services and on the inputs you provide. Your individual circumstances may not be fully reflected in the comparison. You are solely responsible for evaluating whether an offer is suitable for you before continuing outside ChatGPT.

3. External Links, Contracts, Accounts, and Affiliate Disclosure

Preisvergleich is a comparison and referral service. Yavio GmbH is not an electricity supplier, gas supplier, bank, deposit broker, financial institution, or party to any contract or account relationship you may enter into after using the App.

When you click an external link from the App, you leave ChatGPT and continue on a third-party website such as procheck24, CHECK24, an energy provider, or a bank. The terms, prices, interest rates, fees, cancellation rights, statutory information, identity checks, eligibility requirements, and account-opening or contract conditions of that third party apply.

Affiliate disclosure. If you conclude a contract or open an account after clicking a link from the App, Yavio GmbH may receive a commission from procheck24, CHECK24, or another partner. This commission does not influence the comparison logic supplied by procheck24/CHECK24 services. The use of the App and the comparison itself are free of charge for you.

4. Use of the App

You may use the App for lawful purposes only. You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Attempt to interfere with or disrupt the App's functionality.
• Use automated means to access the App beyond its intended use, including in a way that overloads or abuses the underlying data sources.
• Submit information about third parties without their consent or any applicable authorization.

5. Host Platforms and Agentic Clients

The App is offered through ChatGPT (operated by OpenAI) and other clients that connect to the App via MCP. Your use of those clients is subject to their respective terms of use and privacy policies. In the event of a conflict between these Terms and the terms of the host platform, the host platform's terms shall prevail with respect to your use of that platform.

6. Third-Party Services

The App relies on procheck24/CHECK24 services to supply offer data, comparison results, and external continuation links. We do not control these services and are not responsible for the accuracy, completeness, availability, pricing, interest rates, fees, eligibility criteria, or contract terms of the offers they provide.

Providers, banks, and other companies listed in the comparison are independent third parties. Their tariffs, rates, fees, terms, statutory disclosures, and onboarding requirements apply to the contracts or accounts they offer. Your relationship with these third parties is independent of your use of the App.

7. Availability and Accuracy

We strive to keep the App available and functional but make no guarantees regarding uptime or uninterrupted access. Offer data depends on what is provided by third parties and can change at any time. We cannot guarantee that information displayed at the moment of your query is still accurate when you continue outside ChatGPT. The information shown by the relevant third party at the point of contract conclusion or account opening is authoritative.

8. Intellectual Property

All rights in the App's name, branding, and original content remain with Yavio GmbH. You may not copy, modify, or distribute any part of the App without our prior written consent.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Yavio GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, including losses arising from any contract, account, deposit, or third-party service you choose after using the App.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including mandatory provisions of German law.

11. Suspension and Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. Upon termination, your right to use the App ceases immediately. Any contracts or account relationships you have entered into with third parties remain unaffected.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at this URL with a revised effective date. If you do not agree with the updated Terms, you should discontinue use of the App. Continued use of the App after 30 days following the posting of changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the jurisdiction of the competent courts in Germany.
